Augusta wins lawsuit over undelivered XPR music festival

The city is suing the people who were behind an undelivered promise to host a weeklong music and lifestyle festival at a reinvigorated Lake Olmstead Stadium.

AUGUSTA, Ga. (WRDW/WAGT) - Augusta won its legal fight against a company that promised an annual music festival during golf week but city officials said delivered nothing but a torn-up Lake Olmstead stadium.

Many local residents were excited by C4 Live’s plan for the weeklong XPR Augusta music and lifestyle festival at a renovated Lake Olmstead Stadium.

They were sadly disappointed when it never transpired and they waited refunds for the tickets they’d bought.

Blake Shelton, Tim McGraw, Pitbull, Nelly and the now-deceased Jimmy Buffett were supposed to perform at the inaugural event in 2022.

But as the event grew closer, work on the stadium and grounds seemed to halt.

The company ultimately said soil stability conditions on the grounds made the location unsuitable.

The Development Authority of Augusta and the city of Augusta filed suit a little over a year ago against C4 Live LLC.

“Defendant abandoned the project at the Stadium for its own economic reasons unrelated to any subsurface conditions,” the lawsuit alleged.

The lawsuit alleged the defendant failed to surrender the stadium and parking areas in good order and repair.

“Namely, Defendant and/or Defendant’s agents or contractors have severely damaged the Stadium and removed fixtures therefrom,” the lawsuit stated.

“Defendant left the Stadium in a state of destruction and caused it to be unusable,” the lawsuit alleged.

The city claimed it was “entitled to recover all of its costs for prosecuting the instant action including reasonable attorney’s fees” related to the case.

After C4 Live failed to retain counsel as ordered by the judge, the city won a default judgment Wednesday.
