Trucking company files lawsuit after Jan. 9 Bamberg tornado
BAMBERG, S.C. (WRDW/WAGT) - A trucking company in Bamberg is filing a lawsuit against the city and others after a tornado hit the area on Jan. 9.
The lawsuit was filed on Tuesday by Promoe Trucking company, located at 3055 Main Highway in Bamberg.
The lawsuit is against Bamberg County, the city of Bamberg, the South Carolina Department of Transportation, United Demolition, LLC and Neo Corporation.
The lawsuit alleges on Jan. 26, the building at 3055 Main Highway was condemned as unsafe after the tornado.

The lawsuit states the notice did not cite any specific building codes that were violated.
The lawsuit states Premoe Trucking was ordered to take steps to demolish the building and complete demolition within 30 days.
In the lawsuit, the first cause of action states Premoe’s building was not in imminent damage when the defendants demolished it on April 8.
The second cause of action states the defendants did not have permission from Premoe to enter the property to demolish the building.

According to the lawsuit, the third cause of action says the Bamberg defendants violated the due process rights of Premoe by failing to notify the business of its right to appeal the determination of a building inspector.
The lawsuit states the fourth cause of action says the city levied fines against Premoe Trucking for failing to demolish the building upon the city’s notice.
The fifth cause of action states Premoe Trucking asks fines to be denied, the lawsuit states.
The lawsuit states the Bamberg defendants’ negligence caused the building to be demolished in the sixth cause of action.
The plaintiff is asking for punitive damages, an order declaring the city of Bamberg and Bamberg County is not entitled to any fees related to the demolition and cost and attorney fees.
